1. Acceptance of Terms

By creating an AmplifyOne account or activating any digital staff agent (FINN, LISA, RESE, TESSA, or ROSS), you agree to be bound by these Terms and Conditions (“Terms”), our Privacy Policy, and any supplemental agreements presented during onboarding. If you do not agree, you may not access or use the service.

2. Description of Service

AmplifyOne provides an AI-powered workforce that assists with business automation, lead management, communication, and operational workflows. You understand that AmplifyOne acts as a facilitative system, not a human employee or contractor, and that you remain responsible for your business decisions and compliance obligations.

3.User Eligibility

You must be at least 18 years old and have the legal authority to enter into binding contracts on behalf of yourself or your organization. By accepting these Terms, you represent that all registration information you submit is accurate and current.

4. License and Use Rights

AmplifyOne grants you a limited, non-exclusive, revocable license to use the Platform for your internal business purposes. You may not:

• Reverse engineer, resell, or sublicense the system.
• Use the Platform to send unsolicited communications (spam) or violate consumer protection laws (e.g., TCPA, CAN-SPAM, GDPR, CCPA).
• Attempt to interfere with or compromise the security or performance of Amplify One or its infrastructure.

5. Data Ownership and Privacy

You retain ownership of your data. By using AmplifyOne, you grant us a limited license to process your data for the purpose of operating and improving the Platform. Data will be handled in accordance with our [Privacy Policy] and applicable law. You acknowledge that certain AI workflows require access to integrated third-party services (e.g., Google, Meta, CRM systems) and consent to those integrations under their respective terms.

6. Agent Autonomy and Human Oversight

AmplifyOne’s agents act based on predefined workflows and supervised learning models. You agree to maintain human oversight where legally or ethically required. AmplifyOne does not assume responsibility for decisions made or actions taken through your account’s configurations.

7. Fees, Trials, and Subscriptions

Your use of AmplifyOne may include a free trial period followed by a paid subscription. Fees, billing cycles, and cancellation terms are described during checkout and within your account settings. All payments are non-refundable except where required by law or explicitly stated in writing.

8. Intellectual Property

All intellectual property rights in the Platform, including but not limited to its AI models, workflows, designs, and code, are owned by MyWorkforceAgents.AI and its licensors. You may not claim or register trademarks, copyrights, or derivative works based on AmplifyOne materials.

9. Compliance and Legal Use

You agree to comply with all applicable laws and regulations, including data protection, fair housing, advertising, and real-estate communication rules where relevant. AmplifyOne provides compliance overlays (e.g., TCPA/DNC safeguards, MLS disclaimers) but cannot guarantee legal compliance for your specific use cases.

10. Disclaimer of Warranties

AmplifyOne is provided “as is” and “as available.” We make no warranties, express or implied, regarding the accuracy, reliability, or fitness for a particular purpose. Use of AI-driven automation carries inherent risks; you agree to test and validate outputs before reliance.

11. Limitation of Liability

To the maximum extent permitted by law, MyWorkforceAgents.AI and its affiliates shall not be liable for indirect, incidental, or consequential damages arising from your use of AmplifyOne, including but not limited to lost profits, data loss, or reputational harm. Aggregate liability shall not exceed the total fees paid in the preceding six (6) months.

12. Termination

We reserve the right to suspend or terminate access if you breach these Terms, misuse the Platform, or engage in unlawful activity. Upon termination, all rights and licenses granted to you will immediately cease.

13. Modifications

We may update these Terms periodically. Continued use of AmplifyOne after changes take effect constitutes acceptance of the revised Terms. The “Last Updated” date will reflect any changes.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles. Any disputes shall be resolved through binding arbitration in Bexar County, Texas, unless prohibited by applicable law.
